Welcome to Lucid Dream Journal (“App”), a mobile application designed to assist users in recording, analyzing, and tracking their dreams to support lucid dreaming practices and personal reflection. These Terms of Use (“Terms”) govern your access to and use of the App, provided by Simply Productive Apps (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian, and you agree to comply with these Terms. We reserve the right to update or modify these Terms at any time, and such changes will be effective upon posting within the App or on our website at www.luciddreamjournal.app. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

2. Use of the App

2.1 Eligibility

You must be at least 18 years old to use the App independently. If you are under 18, you may use the App only with the permission and supervision of a parent or legal guardian. The App is intended for personal, non-commercial use only.

2.2 License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

2.3 Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Reverse-engineer, decompile, or disassemble the App.
  • Use the App to collect, store, or share personal information of others without their consent.
  • Interfere with or disrupt the App’s functionality, servers, or networks.
  • Use automated systems (e.g., bots, scripts) to access or scrape data from the App.
  • Post or transmit harmful, offensive, or unlawful content through the App.

2.4 Account Registration

To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.
  • Be responsible for all activities conducted under your account.

3. App Features and Limitations

3.1 Functionality

The App allows you to record and categorize dreams, track lucid dreaming progress, set reminders for reality checks, and receive AI-generated insights or tips to enhance lucid dreaming practices. Features may include voice-to-text dream logging, dream pattern analysis, and integration with third-party sleep tracking devices (e.g., Fitbit, Apple Health).

3.2 Accuracy Disclaimer

The App relies on user-entered data and third-party integrations, which may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any insights, analyses, or recommendations provided by the App. The App’s features are intended for personal exploration and should not be relied upon for psychological or medical purposes.

3.3 Not Medical or Psychological Advice

The App is not a substitute for professional medical, psychological, or therapeutic advice, diagnosis, or treatment. The information provided is for general informational and entertainment purposes only and should not be used to diagnose or treat any mental health or medical condition. Always seek the advice of a qualified professional for guidance related to mental health, sleep disorders, or other health concerns.

4. Data Privacy and Security

4.1 Data Collection

We collect personal information you provide, such as your name, email address, dream entries, and sleep-related data (e.g., sleep duration, patterns). We may also collect usage data, such as app interactions and device information, as outlined in our Privacy Policy.

4.2 Data Use

4.3 Data Security

We implement reasonable security measures to protect your data, but no system is completely secure. You acknowledge that you provide personal information, including sensitive dream entries, at your own risk. 5. Intellectual Property

5.1 Ownership

The App, including its design, code, content, and trademarks, is owned by Simply Productive Apps or its licensors and is protected by intellectual property laws. You may not use our trademarks, logos, or content without prior written permission.

5.2 User Content

Any content you submit to the App (e.g., dream entries, notes, custom tags) remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display such content to provide the App’s services.

6. Third-Party Integrations and Services

The App may integrate with third-party services, such as sleep trackers or cloud storage platforms. We are not responsible for the accuracy, reliability, or privacy practices of these third-party services. You should review their terms and privacy policies before using them.

7. Updates and Modifications

We may update or modify the App, including its features or content, at our discretion. Such updates may affect features accessed through subscriptions or one-time purchases. We are not obligated to maintain or support specific features, and access to the App may be discontinued at our discretion.

8. Termination

We may suspend or terminate your access to the App at our discretion, with or without notice, if you violate these Terms or for any other reason, including technical issues or discontinuation of the App. Upon termination, your account and data may be deleted, and you must cease using the App.

9. Limitation of Liability

To the fullest extent permitted by law, Simply Productive Apps, its affiliates, and its partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, emotional distress, or financial losses. The App is provided “as is” without warranties of any kind, express or implied.

10. Subscriptions and One-Time Purchases

Subscriptions

Users may access the App in the following ways:

  • Free Version: Provides limited access to the App’s features, such as basic dream logging and tracking, for an unlimited time.
  • Free Trial: Offers free-of-charge access to all features for a limited time.
  • Paid Subscription “PREMIUM”: A subscription fee-based program that provides access to extra content, such as advanced dream analysis, lucid dreaming exercises, and ad-free usage. You will only have access to the Subscription Program while your subscription is active and subsisting. You can become a subscriber by purchasing a subscription within the App, where allowed by the Application Marketplace Partners (e.g., Apple App Store, Google Play Store). Please note that if you purchase a subscription through the Apple iTunes Store or our iPhone application, the sale is final, and we will not provide a refund. Your purchase will be subject to Apple’s applicable payment policy, which also may not provide refunds. If you purchase a subscription through the Google Play Store, the sale is final, and we will not provide a refund. Your purchase will be subject to Google’s applicable payment policy, which also may not provide for refunds.

The App offers monthly and annual subscription options. For the purposes of our monthly and annual subscriptions, a month constitutes 30 calendar days, and a year constitutes 365 calendar days.

  • Monthly Subscription: Paid in monthly installments. The monthly renewal subscription fees will continue to be billed to the Payment Method you provided automatically until canceled. You must cancel your subscription before it renews each month to avoid billing of the next month’s subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-month subscription period.
  • Yearly Subscription: Paid by an upfront one-off payment with automatic annual renewals. You must cancel your subscription before it renews to avoid billing of the renewal subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial subscription period.

One-Time Purchases

Users may also access additional features or content through a One-Time Purchase, which grants access for a duration not limited by a specific time (subject to reasonable use terms as outlined below). The following terms apply to One-Time Purchases:

  • Non-Refundable: All One-Time Purchases are final, and no refunds will be provided unless required by applicable law.
  • Reasonable Use: Access granted through a One-Time Purchase is valid as long as the App remains operational and supported by Simply Productive Apps. We reserve the right to discontinue or modify the App, including features provided through One-Time Purchases, in accordance with Clause 7 (Updates and Modifications).
  • Platform-Specific Terms: If the One-Time Purchase is made through a third-party platform (e.g., Apple App Store, Google Play Store), the purchase will be subject to the platform’s applicable payment and refund policies.
  • No Transfer: One-Time Purchases are tied to the user’s account and cannot be transferred to another account or device unless permitted by the platform and supported by the App.

11. Indemnification

You agree to indemnify and hold harmless Simply Productive Apps, its affiliates, and its partners from any claims, damages, or losses arising from your use of the App, violation of these Terms, or infringement of third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in California, in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simply Productive Apps regarding the App.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms at our discretion.
